Resolution No. 2015-01

WHEREAS, the Wisconsin Department of Revenue (DOR) proposes to change from municipal assessment to county assessment that requires 100% assessment of every property every year; and,

WHEREAS, this proposal will cause an unfathomable waste of taxpayer dollars through extraordinary cost increases; and,

WHEREAS, citizens will only be able to access a few Board of Review proceedings throughout an entire county, which significantly decreases the ability of local knowledge to create accuracy in the assessment process; and,

WHEREAS, towns, cities, and villages are no longer in control of their own costs because the county will just send them a bill; and,

WHEREAS, the proposal is an unprecedented intrusion into local government by requiring the state to suggest a salary range for their assessment director and work with the county to set a county budget and number of employees; and,

WHEREAS, the DOR has cited assessor problems as part of their rationale, but has never revoked an assessor license despite having the authority; and,

WHEREAS, over the last five years the DOR has already required additional work and detailed information from assessors to improve the process; and,

WHEREAS, this proposals kills private sector jobs and grows public sector jobs; and,

WHEREAS, the DOR cites that Wisconsin is one of few states that has municipal assessment, but forgets to note the strong leadership of Wisconsin citizens, our state’s dedication to local input, and the simple lack of town government in many states;

NOW THEREFORE BE IT RESOLVED, that the Town Board of Clam Falls Township, Polk County does hereby oppose the implementation of county assessment in Wisconsin and asks for the proposal to be removed from the budget; and,

BE IT FURTHER RESOLVED, that Towns are and have always been willing to work with the State of Wisconsin, fellow local government groups, and other stakeholders to continually improve the assessment process.

TOWN OF CLAM FALLS--AFFIDAVIT OF POSTING

I, Jane Schmidt, duly appointed Deputy Clerk of the Town of Clam Falls, Polk County, Wisconsin, hereby verify that the attached Resolution, No. 2015-01 opposing the proposed change from municipal assessment to county assessment has been properly posted in 3 places within our township as required by law under s. 60.80 of Wis. ORDINANCE #2010-01

COMPREHENSIVE PLAN
 
AN ORDINANCE TO ADOPT THE COMPREHENSIVE PLAN OF THE TOWN OF CLAM FALLS, WISCONSIN
 
The Clam Falls Town Board, Town of Clam Falls, Polk County, Wisconsin, does ordain as follows:
 
Section 1.  Pursuant to Section 59.69(2) and 59.69(3) of the Wisconsin Statutes, the Town of Clam Falls is authorized to prepare and adopt a comprehensive plan as defined in Section 66.1001(1) and 66.1001(2) of the Wisconsin Statutes.
 
Section 2.  The Town Board of the Town of Clam Falls, Wisconsin, has adopted written procedures designed to foster public participation in every stage of the preparation of a comprehensive plan as required by Section 66.1001(4)(a) of the Wisconsin Statutes.
 
Section 3.  The Plan Commission of the Town of Clam Falls, by a majority vote of the entire commission recorded in its official minutes, has adopted a resolution recommending to the Town Board the adoption of the document entitled "Town of Clam Falls Comprehensive Plan 2009-2029" containing all of the elements specified in Section 66.1001(2) of the Wisconsin Statutes.
 
Section 4.  The Town of Clam Falls has held at least one public hearing on this ordinance in compliance with the requirements of Section 66.1001(4)(d) of the Wisconsin Statutes.
 
Section 5.  The Town Board of theTown of Clam Falls,Wisconsin, does, by enactment of this ordinance, formally adopt the document entitled "Town of Clam Falls Comprehensive Plan 2009-2029" pursuant to Section 66.1001(4)(c) of the Wisconsin Statutes.
 
Section 6.  This ordinance shall take effect upon passage by a majority vote of the members-elect of the Town of Clam Falls.
 
Adopted by the Clam Falls Town Board of the Town of Clam Falls, Polk County, Wisconsin, this 10th day of February 2010.

ORDINANCE NUMBER 1-2012 (AMENDED)
ALL-TERRAIN VEHICLE/UTILITY TERRAIN VEHICLE ROUTE
 
The Town Board of the Town of Clam Falls, Polk County, Wisconsin, does hereby ordain as follows:
SECTION I – PURPOSE
The purpose of this ordinance is to establish all-terrain vehicle and utility terrain vehicle routes in the town and to regulate the operation of all-terrain vehicles and utility terrain vehicles within the town.
SECTION II – AUTHORITY
The Town Board of the Town of Clam Falls, Polk County, Wisconsin, has the specific authority to adopt this all-terrain vehicle and utility terrain vehicle route ordinance under Wisconsin Statutes 23.33(8)(b) and (11).
SECTION III – ADOPTION OF ORDINANCE
The Town Board of the Town of Clam Falls, Polk County, Wisconsin, by this ordinance, adopted on proper notice with a quorum and roll call vote by a majority of the town board present and voting, provides the authority for the town to designate all-terrain vehicle and utility terrain vehicle routes in the town and to regulate the use of those routes and all-terrain vehicles and utility terrain vehicles in the town.
SECTION IV – OPERATION OF ALL-TERRAIN VEHICLES AND UTILITY TERRAIN VEHICLES
Pursuant to Wisconsin Statutes 23.33(4)(d)4, except as otherwise provided in Wisconsin Statutes 23.33(4), no person may operate an all-terrain vehicle or utility terrain vehicle on the roadway portion of any road in the town except on roadways that are designated as all-terrain vehicle and utility terrain vehicle routes by this ordinance. Operation of all-terrain vehicles and utility terrain vehicles on a roadway in the town that is an all-terrain vehicle and utility terrain vehicle route is authorized only for the extreme right side of the roadway except that left turns may be made from any part of the roadway that is safe given prevailing conditions.
SECTION V – DESIGNATION OF ALL-TERRAIN VEHICLE AND UTILITY TERRAIN VEHICLE ROUTES
All properly signed and posted roads in the Town of Clam.
SECTION VI – CONDITIONS APPLICABLE TO ALL-TERRAIN VEHICLE AND UTILITY TERRAIN VEHICLE ROUTES
Pursuant to Wisconsin Statutes 23.33(8)(d), the following restrictions are placed on the use of the town all-terrain vehicle and utility terrain vehicle routes designated by this resolution:
  1. Routes shall be marked with uniform all-terrain vehicle and utility terrain vehicle route signs (supplied with privately funding) in accordance with s. NR 64.12(7), Wisconsin Administrative Code. No person may do any of the following in regard to signs marking town all-terrain vehicle and utility terrain vehicle routes:
1.      Intentionally remove, damage, deface, move or obstruct any uniform all-terrain vehicle and utility terrain vehicle route or trail sign or standard or intentionally interfere with the effective operation of any uniform all-terrain vehicle and utility terrain vehicle route or trail sign or standards if the sign or standard is legally placed by the state, any municipality or any authorized individual.
2.      Possess any Uniform all-terrain vehicle and utility terrain vehicle route or trail sign or standard of the type established by the department for the warning, instruction of information of the public, unless he or she obtained the uniform all-terrain vehicle and utility terrain vehicle route or trail sign or standard in a lawful manner. Possession of a uniform all-terrain vehicle and utility terrain vehicle route or trail sign or standard created a rebuttable presumption of illegal possession.
B.      Operation shall be subject to all provisions of Wisconsin Statutes 23.33, which is adopted as a part of this ordinance by reference, pursuant to Wisconsin Statutes 23.33.
C.     A copy of this ordinance shall be sent by the town clerk to the Polk County Sheriff’s Department and the Wisconsin Department of Natural Resources.
D.     No person shall operate any all-terrain vehicle or utility terrain vehicle within the Town of Clam Falls at a speed in excess of thirty-five (35) miles per hour.
E.      All all-terrain vehicle and utility terrain vehicle operators shall ride single file.
F.      All all-terrain vehicle and utility terrain vehicle operators shall slow the vehicle to ten (10) miles per hour or less when operating within 150 feet of a dwelling or 100 feet of pedestrians.
G.     All all-terrain vehicle and utility terrain vehicle operators must have a valid driver’s license to operate on any all-terrain vehicle and utility terrain vehicle route.
H.      All all-terrain vehicle and utility terrain vehicle operators shall yield the right-of-way to other vehicular traffic and pedestrians.
SECTION VII – ENFORCEMENT
This ordinance may be enforced by any law enforcement officer authorized to enforce the laws of the State of Wisconsin.
SECTION VIII – PENALTIES
The penalties under Wisconsin Statutes 23.33(13)(a), are adopted by reference.
SECTION IX – SEVERABILITY
If any provision of this ordinance or its application to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of this ordinance that can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are severable.
SECTION X – EFFECTIVE DATE
This ordinance is effective on publication or posting, and shall remain in effect for one year (365 days) from the effective date and is renewable by a resolution of the Town Board of the Town of Clam Falls any time prior to the one-year anniversary of the effective date. If no resolution or ordinance, amendment by the Town Board of the Town of Clam Falls renews this ordinance, it shall expire one year from the effective date.
The town clerk shall properly publish this ordinance as required under Wisconsin Statutes 60.80.
